Purchase Conditions

To make a purchase on wandaclean.com the customer must first accept the following conditions by checking the box “I have read and accept the terms and conditions”. The sale will not be made if the client does not accept the conditions.

SERVICE DESCRIPTION

1.            Registration

Wandaclean.com is e-commerce that offers cleaning devices and cleansers for espresso coffee machines. The store is located at www.wandaclean.com (hereinafter, wandaclean.com) which has been developed by WANDA CLEAN NZ Ltd. with an address at 16th Bell Street, 4501 Whanganui. The sale of our products is made exclusively retail.

2.            Customer Base

Orders placed by customers in our online store, wandaclean.com, are exclusively subject to the following General Terms and Conditions. We do not accept the conditions of the client or of third parties that differ from ours unless we have expressly accepted their validity.

3.            Orders, Hiring and Counterparty

With the provision of products in the online store for purchase, wandaclean.com does not make a binding offer for the conclusion of a contract on these products. The offer to enter a purchase contract is made by the customer when making the purchase of the products that have been included in the shopping cart.

The customer will see a confirmation window with the details of his order in which he can check and correct the necessary data before placing the order.

Just upon confirming the order, you will receive an email with the order confirmation, which in no case will represent the acceptance of the offer.

The contract will be carried out when wandaclean.com accepts the offer, either by sending the products or the corresponding email in which it expressly accepts the conclusion of the purchase contract. This will also apply when you have paid the purchase price before the conclusion of the contract or authorized the payment.

In case we cannot accept your order due to lack of stock or if the contract is not celebrated for other reasons, we will reimburse the advance payment immediately.

4.            Right of Withdrawal

As a consumer, you have by law a right of withdrawal.

5.            Storage of the Contract Text

We keep the data of the order that you have entered in accordance with the data protection regulations and the client can request us to provide it. In addition, during the order process, you have the option to print your order and the data entered. If you have a customer account, you can also view the details of your order in your customer area by entering your personal access data. As part of the order confirmation, the order data is sent to the email address specified by you.

6.            Delivery Area, Delivery, Supply Reserve

At wandaclean.com we serve our products worldwide, except in the countries where UPS does not operate like Cuba. Unless stated otherwise in the offer, the customer will choose the appropriate delivery method and the shipping company will be UPS.

The delivery is carried out at the delivery address specified during the purchase of the product. If possible, you will receive your order in a single shipment. If a separate shipment is necessary for technical or logistical reasons, you will not incur any additional costs.

Delivery time

Delivery to the delivery address specified by you is made within 3 to 4 days for deliveries in New Zealand and the European Union (subject to delays caused by environmental reasons or causes beyond our control).

For deliveries outside of New Zealand and the European Union, the shipping periods range from 7 to 15 days.

7.            Prices, Shipping Costs, and Discount Codes

All the prices indicated are fixed prices in New Zealand dollars (NZD, $) that contain the Legal Value Added Tax (VAT).

For shipments to New Zealand and the European Union, shipping costs are free for all orders over NZD 20. And if the amount of the order is less than NZD 20, the shipping costs are NZD 6.95.

In the case of shipments to the Canary Islands, Ceuta and Melilla, the shipping costs are NZD 25 and it cannot be purchased with the cash-on-delivery method.

For shipments outside New Zealand and the European Union, shipping costs are free for all orders over NZD 70. And if the order amount is less than NZD 70, the shipping costs are NZD 20.

Discount codes, whether promotional codes or gift codes, can be entered at the end of the order in the field “Do you have a discount code?”. To apply the discount, you must click on the Redeem discount code button.

8.            Payment

Unless otherwise specified in the offer, payment can be made by Credit/Debit Card (Visa or Mastercard) or PayPal. We reserve the right in each order not to offer certain types of payment methods and to refer to other methods.

Wandaclean.com will withdraw from the PayPal account or the Customer Credit/Debit Card the amount of the invoice immediately after the reception of the order.

Payment by Credit/Debit Card

Payment by Credit/Debit Card takes place through Kiwibank.

Payment by PayPal

The invoice amount will be paid through PayPal (Europe) S.a.r.l. & Cie, S.C.A., 5th Floor 22-24, Royal Boulevard, 2449 Luxembourg. The user must be registered in PayPal or registered before making the payment. During the order process, you will be directed to the PayPal website, where you can register with your user data and confirm the payment on our behalf. The purchase price will be charged immediately.

9.            Reservation of Property

The products remain the property of wandaclean.com until the complete payment has been made.

10.          Warranty

If the products delivered are defective, legally recognized rights will apply.

11.          Limitation of Liability

In the event of non-compliance with our obligations due to slight negligence, our liability is limited to the direct and typical average damage that would be foreseeable due to the nature of the assets. This also applies to breaches of obligations by our legal representatives or auxiliary agents.

We will not be liable to employers in case of breach of non-essential contractual obligations due to slight negligence. The limitations of liability mentioned above do not affect the customer’s claims arising from product liability. In addition, the limitations of liability do not apply to the person or health damage of the client or to his death when it is imputable to us.

12.          Applicable Law, Jurisdiction, and Alternative Dispute Resolution

The law of the New Zealand State shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods, insofar as it does not conflict with any international consumer protection law.

The European Commission provides an online dispute resolution platform that can be found at http://ec.europa.eu/consumers/odr/. We are neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration body.

13.          Language of the Contract

The language of the contract is English.

CONSUMER INFORMATION ON WITHDRAWAL

Right of withdrawal

You have the right to withdraw from this contract within a period of 14 days without the need for justification.

The withdrawal period will expire 14 days from the day that, you or a third party indicated by you other than the carrier, acquires the material possession of the goods.

To exercise the right of withdrawal, you must notify us of your decision to withdraw from the contract through an unambiguous statement (for example, a letter sent by mail or email to: WANDA CLEAN NZ Ltd., 16th Bell Street, 4501 Whanganui, New Zealand; email: wandaclean@wandaclean.com).

To comply with the withdrawal period, it is sufficient that the communication relating to the exercise of the right of withdrawal is sent before the expiration of the withdrawal period.

Consequences of Withdrawal

In case of withdrawal, we will refund all payments we have received on your part, including delivery costs except for the additional costs resulting from your choice of a different mode of delivery to the least expensive delivery method offered. Without any delay, and at the latest, within a period of 14 days from the date on which we are informed of your decision to withdraw from this contract. The refund will be made using the same payment method used for the initial transaction unless you have expressly provided the contrary. You will not incur any expense with the reimbursement. We may withhold reimbursement until we have received the goods, or until you have submitted proof of the return of the goods, depending on which condition is met first.

For returns, you must contact WANDA CLEAN NZ Ltd., 16th Bell Street, 4501 Whanganui, New Zealand; email: wandaclean@wandaclean.com, and we will provide all the necessary information to make the return. The return costs are borne by WANDA CLEAN NZ Ltd.

The customer will be responsible for the decrease in value that the goods may suffer only when said a decrease in value results from unnecessary manipulation to establish the nature, characteristics, and operation of the products.

Exclusion or early termination of the right of withdrawal

The right of withdrawal does not apply to contracts for the supply of non-manufactured goods whose production has been tailored according to an individual choice or instruction by the consumer or that are clearly adapted to the personal needs of the consumer.

The right of withdrawal expires early in the case of contracts for the delivery of sealed products that are not suitable for return for reasons of health or hygiene if their seal has been removed after delivery.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.
